1. General introduction

Welcome to Pagemira.com! We are a privately held company in the United States providing booksellers, individual book lovers, industry partners and conscious consumers with direct-to-consumer e-commerce solutions in the United States. Our Platform offers a variety of services and features, including book sales and the ability for qualified independent bookstores to host their own stores on our Sites.

By using Pagemira.com (the “Website”) you agree to these Terms of Service (“ToS”). The ToS, along with our Privacy Policy, govern your use of the Website, our mobile messaging service, affiliate marketing program (if applicable), and Platform Vendor program (if applicable). All definitions on this website are interpreted in accordance with United States law

Please read the ToS carefully, as they constitute a legally binding agreement. If you disagree with any part of the ToS, you mustn’t use the Website.

Eligibility

  • You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Website. Users between 13 and 17 may use it with a parent or guardian’s permission and supervision.

Account Creation and Responsibility

  • To access certain features, you’ll need to create an Account. Provide accurate information and keep your login credentials secure.
  • You are responsible for all activity under your Account, even if unauthorized. Notify us immediately of any suspected security breach.

Website License

  • We grant you a limited, non-exclusive, revocable license to access and use the Website for personal or commercial purposes (if you’re an eligible Vendor), as expressly permitted by these ToS.
  • You may not copy, modify, distribute, or otherwise exploit Website content or features without our express permission.

Disclaimers

  • The Website is provided “AS IS” without warranties of any kind. We make no promises about the accuracy, reliability, or results from using the Website.
  • We do not endorse or guarantee any User-generated content (including Vendor Content), products, or services from third parties. Your interactions with them are at your own risk.
  • We may have links to third-party sites. We are not responsible for their content or actions.

Limitation of Liability

  • We are not liable for any losses incurred from using the Website, including lost profits, data loss, or other indirect or consequential damages.
  • This limitation applies to the maximum extent permitted by law.

Mobile Message Service (SMS)

  • We offer an optional SMS service. By opting in, you consent to receiving automated text messages about promotions, updates, etc.
  • Standard messaging rates apply. You can opt out at any time using the “STOP” keyword or by contacting us.

Affiliate Program

  • Eligible individuals can join our Affiliate Program to promote the Website. You’ll receive a commission on sales generated through your unique links.
  • You must use our approved marketing materials responsibly and ethically. Do not misrepresent Pagemira.com or make false claims.

Pricing & Inventory

  • Vendors are solely responsible for setting accurate prices for merchandise listed on our online marketplace. Pagemira.com is not responsible for any pricing errors.
  • Vendors must keep inventory information up to date to ensure products are listed as “out of stock” when unavailable. Failure to do so may result in delayed orders or cancellations.

Shipping & Delivery

  • Vendors generally handles shipping and delivery of Merchandise purchased through our online marketplace shipping policy.
  • Shipping costs may vary and will be calculated and displayed at checkout.
  • Typical estimate delivery times are 9 days from order confirmation, though delays may occur. Pagemira.com is not responsible for shipping carrier delays.
  • Vendors are responsible for promptly communicating any unexpected shipping delays directly to their customers.

Returns & Refunds

  • Pagemira’s general return and refund policy applies to Merchandise purchased through our online marketplace Returns & Refunds policy.
  • Vendors on the Platform may only offer additional or different return policies in their stores that are more beneficial to buyers such as shorter processing times, lower costs, simpler requirements ,… compared to Pagemira’s default Return and Refund policy.

2. Platform Vendor Program

  • Independent bookstores that are members of the American Booksellers Association (ABA) can become Vendors on Pagemira.com.
  • Individuals who love books and legally own them can become Vendors on Pagemira.com.
  • Vendors earn a portion of the revenue generated through our online marketplace.
  • Vendors are responsible for their own interactions with customers and must ensure their vendor content does not infringe on any intellectual property rights.

Expanded Platform Vendor Responsibilities

In addition to the general responsibilities outlined in the Platform Vendor Program section, Vendors must specifically adhere to the following:

  • Product Information Accuracy: Vendors are solely responsible for ensuring the accuracy and completeness of all product information displayed on our Marketplace, including:

    • Product descriptions: Provide clear, detailed, and truthful descriptions of the products, highlighting any unique features or specifications.
    • Product images: Use high-quality images that accurately represent the product’s appearance, condition, and any included accessories.
    • Pricing: Set accurate prices that include all applicable taxes and fees.
    • Availability: Ensure inventory information is up-to-date to reflect product availability.
    • Follow prohibited items instructions: See the page explaining prohibited items here.
  • Intellectual Property Rights: Vendors must ensure that they have the legal right to sell any products listed on our online marketplace. This includes obtaining any necessary licenses or authorizations from copyright or trademark holders.

  • Conflicts of Interest: Vendors must disclose any potential conflicts of interest related to the products they sell. This could include, for instance, if they are also the manufacturer of a product or have a financial stake in the company that produces it.

  • Adherence to Laws and Regulations: Vendors must comply with all applicable laws and regulations, including those related to product safety, labeling, and advertising. 

Customer Service Requirements

Vendors must provide responsive and customer-centric support to their customers. This includes:

  • Clearly Visible Contact Information: Make it easy for customers to contact you for inquiries or issues related to their orders. This could include providing a dedicated contact page on your store, an email address, or a phone number.
  • Prompt Response Times: Respond to customer inquiries and complaints promptly and professionally. Aim to acknowledge communications within 12 hours and provide a resolution within 3 business days.
  • Order Issue Resolution: Work diligently to resolve any order issues that customers may encounter, such as damaged products, delivery delays, or incorrect items. This may involve providing replacements, refunds, or other appropriate solutions.
  • Adherence to Return Policies: Honor the return policies you have communicated to customers. This includes providing clear instructions on how to return items, processing returns promptly, and issuing refunds in a timely manner.

Prohibited Conduct

To maintain a fair, transparent, and trustworthy marketplace, Vendors are strictly prohibited from engaging in the following conduct:

  • Deceptive Pricing: Falsely advertising prices, using hidden fees, or engaging in bait-and-switch tactics.
  • Misrepresenting Product Availability or Shipping: Claiming to have products in stock when they are not, or providing inaccurate shipping timelines.
  • Failing to Honor Return Policies: Not adhering to the return policies communicated to customers, delaying refunds, or imposing unreasonable return conditions.
  • Providing False or Misleading Business Information: Misrepresenting your company’s name, contact information, or affiliation with any organizations.
  • Engaging in Fraudulent or Spammy Marketing Practices: Using deceptive marketing tactics, sending unsolicited emails, or creating fake reviews.
  • Infringing on Intellectual Property Rights: Selling products without the necessary licenses or authorizations, or using copyrighted materials without permission.
  • Engaging in Illegal or Unethical Activities: Violating any applicable laws or regulations, or engaging in activities that could harm or mislead customers.

Enforcement

Pagemira.com takes the integrity of its platform seriously and reserves the right to take action against any Vendors who violate these ToS. This may include:

  • Removal of Specific Listings: Removing listings for products that are found to be misrepresented, inaccurate, or in violation of any policies.
  • Store Suspension: Suspending the store privileges of Vendors who engage in repeated or serious violations of the ToS.
  • Account Termination: Terminating the Account of Vendors who engage in severe or fraudulent behavior.
  • Legal Action: In cases of serious misconduct, Pagemira.com may pursue legal action against Vendors.

3. Changes to the ToS

  • We may update the ToS from time to time. We’ll notify you of material changes.
